Analysis of legal acts on technical service agroindustrial production

Abstract

Formulation of the problem. Periodic changes in the prices of equipment, spare parts and fuel reduced the purchasing power of farmers, they lack the funds to purchase necessary equipment for the timely implementation of agricultural work. In the market of agricultural equipment and its technical service dominated by foreign manufacturers, their representatives and dealers. The advantages of foreign equipment in the higher its reliability. Disadvantages - the high cost of both the engineering and technical services, making it unavailable to most small and medium-sized farms. Benefits agricultural machinery production in Ukraine is lower price. Objective research. The aim of this work is the analysis of legal acts on technical service agricultural production.  Results. The article describes the analysis of the current legislation on technical service of agricultural production. We consider the law of Ukraine on the engineering and technical support, the establishment of market competition environment, the protection of the rights of buyers of agricultural machinery, promoting the development of domestic engineering. Noted disadvantages of sectoral legislation concerning state regulation of the markets of technical service and creating a competitive environment. It is necessary to provide transition to new techniques when determining losses from an outage of technology taking into account the suffered losses and the missed benefit. Raised questions about the increasing influence of public authorities to regulate the market for agricultural machinery industry and its technical services. This will raise the share of machinery, manufactured in Ukraine to avoid monopoly position of foreign technology on the market. as the technical service of foreign companies and their representatives do not fully meet the requirements of farmers. This is especially true for the cost of equipment and services, as well as the timing of orders. The high cost of foreign technology and technical service can not be used by small farms. When stimulation of the domestic agricultural mechanical engineering must take into account their network of technical service. Paying attention to the unification of the conceptual apparatus of the current sectoral legislation. It should be brought into line, unifying terms in the law on technical service of agriculture.

Conclusions. The article analyzed and discussed some issues of technical regulation. Today, in the current legislation, there are some disadvantages of the old and new laws. In general, there is no concept of "system" in the field of technical regulation. Showing EU documents, defining common procedure and conditions for the supply of goods on the EU internal market. It is necessary to improve legislation in the field of consumer protection and technical regulations.
